Serious results can occur from violations of your probation agreement. Because when you signed the probation agreement, the board effectively suspended your license but gave you permission to continue to practice nursing, provided you follow the terms of your probation agreement. Probation agreements contain punitive language that gives the Board the power to suspend your license and ability to practice when any violation occurs, at their discretion

If you’re a nurse who has already been placed on probation, it can be a stressful and overwhelming period of time, usually lasting as long as five years. During the probation period, nurses can sometimes–even inadvertently–violate the terms of those agreements. Every year, we are retained by concerned nurses on probation who may have violated one more of these terms. Here are some examples of typical violations:

  • Testing “dilute” on a random drug screen
  • Failure to show up timely for a random drug test
  • Testing positive on a random drug test
  • Missing or skipping required counseling or support meetings
  • Failing to take classes within the deadline period

When a nurse violates any of the terms of a probation agreement, the Board has the power to handle the situation in several different ways:

  1. Immediately suspend a nurse’s license
  2. Subject the nurse to additional investigation, which often results in fresh allegations and new complaints being filed
  3. Place the nurse on the Board’s next hearing scheduled to consider further action against that nurse, including revocation of a license
  4. Renegotiating terms to a probation agreement, such as extending the probationary period (i.e., adding additional time)
  5. Consider the entirety of the circumstances and give the nurse a warning
