Serious results can occur from violations of your probation agreement. Because when you signed the probation agreement, the board effectively suspended your license but gave you permission to continue to practice nursing, provided you follow the terms of your probation agreement. Probation agreements contain punitive language that gives the Board the power to suspend your license and ability to practice when any violation occurs, at their discretion

If you’re a nurse who has already been placed on probation, it can be a stressful and overwhelming period of time, usually lasting as long as five years. During the probation period, nurses can sometimes–even inadvertently–violate the terms of those agreements. Every year, we are retained by concerned nurses on probation who may have violated one more of these terms. Here are some examples of typical violations:

  • Testing “dilute” on a random drug screen
  • Failure to show up timely for a random drug test
  • Testing positive on a random drug test
  • Missing or skipping required counseling or support meetings
  • Failing to take classes within the deadline period

When a nurse violates any of the terms of a probation agreement, the Board has the power to handle the situation in several different ways:

  1. Immediately suspend a nurse’s license
  2. Subject the nurse to additional investigation, which often results in fresh allegations and new complaints being filed
  3. Place the nurse on the Board’s next hearing scheduled to consider further action against that nurse, including revocation of a license
  4. Renegotiating terms to a probation agreement, such as extending the probationary period (i.e., adding additional time)
  5. Consider the entirety of the circumstances and give the nurse a warning

When our law firm is contacted by a nurse who is alleged to have violated the terms of probation, we thoroughly evaluate the circumstances, and based upon our experience of handling hundreds of cases, and our dealings with Board staff, we explore the range of likely outcomes under the circumstances.

Our law firm is also routinely retained by nurses to help them interact with the Board to achieve an optimal result in negotiating a resolution to an alleged violation of a probation agreement. Here are the kinds of things we do and have done in cases of alleged violations:

  • Challenging the results of a positive drug test when a nurse is certain was no violation committed (at least not intentionally)
  • Explaining the basis of a dilute drug test, which the Board considers a violation of probation (it is a violation that is specifically spelled out in most probation agreements related to substance abuse)
  • Considering alternative ways to address violations to the satisfaction of the Board without having to resort to a short or long-term suspension of a license.
  • Assisting nurses in understanding and explaining the underlying causes for the violation, along with an honest assessment of how to prevent future violations, and going to the Board with a plan to prevent future violations.

It is disheartening to see nurses go months and even years with a perfect performance record on the terms of their probation, only to have them make a mistake that threatens their license. In this process, we have often played a positive if not crucial role in helping nurses avoid suspension due to such violations.

We can help you navigate through your probation period. In addition to the things we have listed above, we are also retained by nurses on probation for the following reasons:

  • Help negotiate the original terms of the probation agreement. Our role in helping nurses avoid unnecessary or overreaching terms of a stock probation agreement cannot be underestimated. We can discuss this during your free consultation with the LV Nurse Attorney.
  • In cases where nurses contact our law firm early on in the process, sometimes a looming probation agreement can be averted, and lesser disciplinary action, closure, or dismissal of the complaint can be negotiated.
  • Explain the terms of the probation agreement to a nurse in “plain English” or in such a way that nurses understand the full meaning and effect of each portion of the Agreement. To be sure, at the time of orientation with Board staff, a nurse will understand the terms of the agreement; however, many nurses want to know “what they are getting into” before they sign, and seek legal advice before signing.
  • Assist the nurse throughout the term of the probation agreement. Oftentimes, nurses have questions or situations that arise during the course of their probation agreement. Can I go on vacation? Can I leave the country? Can I change my support group? Can I modify the terms of my probation? I messed up, what can I do to fix it? While some of these questions can be asked of the Board staff who monitors these agreements, most nurses prefer to seek confidential legal counsel to address the matters, and how to proceed.

In conclusion, LV Nurse Attorney is here to guide you through the probation process, one step at a time–before, during, or after a probation agreement is in place.

If you’re a nurse in Nevada facing a formal or informal hearing, you need an experienced Nevada Nursing Board Attorney who can provide knowledgeable and compassionate representation. At LV Nurse Attorney, we understand the complexities of nursing law and are committed to protecting your rights and license.

Our Approach

  • We take a collaborative approach with our clients, keeping you informed throughout the legal process.
  • Our legal team has years of experience representing nurses before the Nevada State Board of Nursing and other regulatory bodies.
  • We work to minimize the impact on your personal and professional life while fighting for the best possible outcome.

Formal Hearings

A formal hearing is held before the seven members of the Nevada State Board of Nursing, the outcome of which can have serious consequences for your nursing license. We will provide a comprehensive defense strategy that is tailored to your specific case. We will ensure that all relevant evidence is presented and that all legal avenues are explored in order to protect your license and livelihood.

Formal hearings usually occur when a nurse disputes the factual allegations of a case. These cases are usually much more time-consuming to prepare for than an informal hearing. Discovery is done: witnesses can be interviewed or deposed, and documents can be subpoenaed, and experts called.

Informal Hearings

An informal hearing is a less formal process that still requires experienced representation. It usually occurs after negotiations with Board staff failed to achieve a mutually agreeable outcome. Typically, the facts of what occurred are not in dispute, only what the outcome should be. In other words, the nurse-client, in consultation with the nurse’s attorney, has decided to present the case to the Nursing Board, who will decide what the outcome will be.

Prior to any hearing, informal or formal, Attorney Craig Perry can negotiate with the regulatory body to achieve a resolution that is in your best interest. We will work to minimize any potential consequences and protect your rights. If the attorney and client conclude that an optimal result cannot be achieved without a hearing, our legal team will represent you at a hearing. Contact us today to schedule a free consultation.

Don’t risk your nursing license and livelihood without adequate representation. We will provide the experienced and compassionate legal guidance you need.

At LV Nurse Attorney, we understand that losing your nursing license can be a devastating experience. However, our law firm has experience representing nurses in reinstatement proceedings.

Our legal team will work to help you prepare your case and present a compelling argument for why you should be allowed to practice nursing again. We will help you navigate the complex legal process and advocate on your behalf to protect your rights.

As a nurse in Nevada, you are required to complete continuing education (CE) hours to maintain your license. However, the Nevada State Board of Nursing (NSBN) may conduct CE audits to ensure that you have completed the required hours. If you are found to be deficient in your CE hours, you could face disciplinary action from the NSBN. Recent changes may be around the corner, as the NSBN considers other less punitive ways to handle CE deficiencies.

Two of the recent problems we have seen with CE deficiencies is the following:

  1. Failure to keep records of the BioTerrorism course. These records must be kept throughout your entire nursing career in case you are ever audited; If you did not maintain them, take the class again and keep those records. This is a required, one-time course; and
  2. Failure to pay attention to new and recurring course requirements; the lates is two hours of cultural competency. Read NSBN Article on this issue.

At LV Nurse Attorney, we understand how stressful it can be to face a CE audit or deficiency. That’s why our team of experienced nurse attorneys is here to help.
